What Benefits are Available?

Settlement benefits are paid from the $5,500,000 Settlement Fund according to the Plan of Allocation. Eligible Settlement Class Members may receive:

1. Pet Injury Claims

Settlement Class Members who claim that a covered Mid America Pet Food Product caused pet illness or death may seek:

• Documented Pet Injury Claims: Paid at 100% of approved documented losses, up to $100,000 per Valid Claim Form. Acceptable documentation includes veterinary records, invoices, receipts, payment records, or other evidence of expenses and losses, including necessary future care related to the exposure.
• Undocumented Pet Injury Claims Supported Solely by Declaration: Paid at $50 for pets that became ill but did not die, or $100 for pets that died. These claims must be credible in the judgment of the Settlement Administrator.
• Breeder Claims: For breeders with documented business related pet injury losses, up to the same $100,000 cap per Valid Claim Form.

2. Consumer Food Purchase Claims

• Documented Food Purchase Claims: Paid at 100% of approved purchase price for covered Mid America Pet Food Products with documentation such as receipts, invoices, order confirmations, or proof of payment.
• Undocumented Food Purchase Claims: $20 per bag of covered product, up to two bags per Settlement Class Member, for a maximum of $40 without receipts.

3. Pro Rata Adjustments
If there is money left in the Net Settlement Fund after paying all valid claims at full value, approved claims may be increased proportionally. If there is not enough money to pay all valid claims in full, payments will be reduced on a pro rata basis.

How Do I File a Claim?

To receive any payment, you must submit a Claim Form. You can:

• File online through the official settlement website, or
• Complete and mail a paper Claim Form to the Settlement Administrator.

Each Claim Form must be fully completed, signed, and, if applicable, include supporting documentation for pet injuries or product purchases. Follow the instructions on the form carefully.

What is the Claim Form Deadline?

Your Claim Form must be submitted online, or postmarked if mailed, by February 5, 2026. Late claims are expected to be denied and treated the same as doing nothing.

When Will I Get Paid?

Payments will be issued after:

• The Court grants final approval of the settlement at or after the Final Approval Hearing on February 6, 2026,
• Any appeals are resolved, and
• Claims are reviewed and processed under the Plan of Allocation.

This process can take time. Approved claimants will be notified by the Settlement Administrator regarding their payment amount.

What Rights Do I Give Up?

Unless you exclude yourself, you will remain in the Settlement Class and will release all claims related to the recalled Mid America Pet Food Products and alleged Salmonella contamination that were or could have been raised in this case. You will not be able to sue Mid America Pet Food separately for those same issues.

What Are My Options?

Submit a Claim: Receive payment if eligible and your claim is approved.

To opt out, you must mail a written Exclusion Request to the Settlement Administrator so it is postmarked no later than January 6, 2026. Your request must include your full name, current address, a statement that you wish to be excluded from the Settlement Class in Filardi v. Mid-America Pet Food, LLC, Case No. 23-cv-11170-NSR, and sufficient proof that you are a Settlement Class Member.

How to Object

If you do not exclude yourself, you may object by sending a written objection postmarked no later than January 6, 2026 to the Court, the Settlement Administrator, Class Counsel, and Defendant’s Counsel. Your objection must include the case name and number, your contact information, reasons for your objection, proof of class membership, and whether you intend to appear at the Final Approval Hearing.

How Do I Qualify For a Payout?
